A motorist has successfully appealed a Glasgow Low Emission Zone fine after receiving a Penalty Charge Notice even though his car was legal.
Glasgow City Council could be raking in fortunes from motorists in wrongly-issued air pollution fines. The Council introduced new Low Emission Zones in June, with a view to cleaning up the city's air.
"The council website says that cars are 'generally compliant' if they are 2006 or later. But mine is 2005 and compliant. My V5 log book confirms the car is Euro 4, so I sent that to the council, who then confirmed they were overturning it." "I have therefore withdrawn the above Notice. I would advise you to contact Low Emissions Scotland as they can amend their records if provided the relevant evidence. Please accept my apologies for any inconvenience caused."
"They are what's known as Euro 4 for petrol vehicles and Euro 6 for diesel vehicles, Euro IV for heavy duty petrol vehicles such as buses, coaches and HGVs and Euro VI for heavy duty diesels. The council website adds: "For practical purposes, it is generally the case that diesel engine vehicles registered after September 2015, and petrol vehicles registered from 2006 onwards will meet the required LEZ standards.
"The information used to determine whether a vehicle is compliant with the LEZ is taken from the DVLA and Glasgow City Council has no power to change this information.
