He didn't get away with it

Rana Faisal Jameel was brought to court after Chorley Borough Council staff carried out checks on a licensed premises on October 31 last year. Council officers observed Jameel, who was the driver of a vehicle licensed by Blackburn with Darwen Borough Council, smoking a cigarette whilst travelling on Eaves Lane, Chorley.

The offence occurred as a licensed vehicle is considered to be a smoke-free place for the purposes of the Health Act 2006, meaning it is an offence to smoke in one. Officer investigated the vehicle and found the driver to be Jameel.Adele Hayes, Head of Planning and Enforcement at Chorley Council said: “Smoking in a smoke-free place is a serious matter.

Jameel, 49, was issued with a fixed penalty notice, which required him to pay a fine. However, despite attempts to contact Jameel by both Chorley Council and Blackburn with Darwen Council, Jameel did not pay the fine. Therefore, the taxi driver was prosecuted by Chorley Council via the Single Justice Procedure. Blackburn Council assisted with the case by providing a witness statement.

As Jameel, of Logwood Street, Blackburn, failed to respond to the notice, he was found guilty in his absence. The driver was then fined £220 and ordered to pay a victim surcharge of £88, plus the Council's costs of £150.
