A chef at the former Oscar Bar and Kitchen took owners SBC Empire Limited to an employment tribunal over unlawful deductions from wages, breach of contract and unfair dismissal.
The owner of a Glasgow restaurant that shut down days after staff complained about being threatened with unfair deduction of tips has been taken to court.
Just days after Christmas in December 2022, he was dismissed without a notice period and without being paid for untaken holidays. Judge Kemp said there had been "no proper basis" for Flanagan's dismissal or any evidence of wrongdoing. "The claimant had separately an entitlement to notice at a minimum level having regard to section 86 of the Employment Rights Act 1996 of one week, and that is due, which is the net sum of £227.89 - appropriate measure of damages for the respondent’s breach of contract in not giving him notice of termination of employment, as he was entitled to. The total award of those sums is the sum of £1,317.39.
