The court said Lindt product should be protected from duplicates
Lidl has been order to melt down its gold-foil wrapped chocolate rabbits as they are too similar to Lindt version.
The budget supermarket was told to melt down all its remaining stock after a Swiss court said they were too similar to those made by Lindt & Sprüngli, reports The Guardian. . Lindt's version of the chocolate rabbits are one of the company's best selling products, with 10 million being sold every year. The court rules that the Lindt version of the product was known to the public.For this reason, it was ruled that the Lindt and Lidl products are likely to be confused. Lindt has been to court multiple times to protect its rabbits. It applied for a trademark on the treat which was granted in 2001.
The court said that the Lidl chocolate can be melted down and turned into something else, so it doesn't have to be thrown away. Neither Lindt nor Lidl have yet made a statement about the ruling, WalesOnline reports. In February this year, Aldi settled a legal battle with Marks & Spencer which said the German supermarket's Cuthbert caterpillar cake was too similar to its own.
