Mr A Rodgers worked as a cleaner and caretaker of a building from June 2002 for a company that was then taken over by Eyekon Services.On September 9 last year, Mr Rodgers was told that Eyekon Services had lost the contract for the building and that he was being dismissed with immediate effect.A recent employment tribunal decided Mr Rodgers had been dismissed unfairly and that he was entitled to compensation.
Employment judge D Hoey said: “There was no consultation nor discussion with the claimant. No attempt was made to engage with the claimant and consider alternatives to dismissal. “His dismissal was unfair. There was no evidence that following a fair procedure would have resulted in his dismissal occurring in any event or within any period thereafter, the claimant’s job continuing to exist.Mr Rodgers was awarded £5490 by way of a basic award which would mirror a redundancy payment.
