Darin Harvey denies murdering Felicity-May Harvey
A father who denies shaking and murdering his baby daughter has told a jury the child's mother was responsible - claiming 'there's no other explanation'.
Mr Harvey gave evidence over two days at his trial, questioned by prosecutor Tim Storrie KC and defence barrister James Mulholland KC. He told the court he has a son from a previous relationship. After meeting Ms Connolly in early 2020, they decided to have a child together. Mr Harvey said that around 2pm, Ms Connolly went upstairs at their Stirling Place home to do her hair and smoke, which was 'unusual'. Ms Connolly left the house soon after and sent him a WhatsApp message saying Felicity-May was 'due a feed', which was also unusual according to Mr Harvey.
"I tried to get her to respond by touching her. But there was nothing. I pulled my phone out and Heather was the first number I saw. I know I should have phoned an ambulance but my head was gone." Mr Harvey added: "I wanted to help police and tell them everything I could. They wouldn't accept anything I was saying.
"You were asked about who you were sending a Facebook message to at 14.29. When did you decide to tell the truth about going to the loo?," Mr Storrie asked. "They knew what they were doing and they are taking advantage of a broken man who lost his daughter. It looks like I'm lying, but it's cruel. They were saying I shook her when I didn't.""My head was all over the place because of my daughter," the defendant replied. "They took advantage of that - it was torture. I was a broken man who had lost their daughter... all they were doing was interrogating me, it will scar me for the rest of my life.
